Timothy’s Autopsy Report Proves Felony- Murder-Slayer Laws Applicable

Relevant points taken from the Timothy’s autopsy report, reveal the following determinations:
  • The decedent is a 34-year-old male with a history of Diabetes mellitus type I, cocaine, alcohol, and tobacco use, and anxiety disorder, who was found prone and unresponsive on his bedroom floor by his roommate. Death was pronounced on scene. There were no indications of trauma or foul play.
  • Postmortem examination showed an adult male with […] no significant/lethal trauma was identified.
  • Postmortem toxicology was negative for ethanol, screened drugs of abuse, and select therapeutic medications.
  • Postmortem vitreous fluid analysis revealed elevated levels of glucose (>800 mg/dL), acetone (40 mg/dL), creatinine (2.76 mg/dL), and urea nitrogen (57.8 mg/dL) consistent with diabetic ketoacidosis and renal dysfunction.
  • CAUSE OF DEATH: Diabetic ketoacidosis due to diabetes mellitus type I.
  • MANNER OF DEATH: Natural

Timothy’s “Autopsy Report” Supports Allegations by Parents.

Timothy’s parents were aware of his history of alcohol and tobacco use, but cocaine use was recent, and his anxiety disorder was not known, but witnessed in his disposition while trying to settle a divorce he wanted to be amicable.

Timothy’s court filings evince that he was seriously distressed about the situation, as he did not expect nor anticipate the events that happened between him and estranged wife during the past two-years. Those close to him, knew he passionately loved his family and had plans to always stay close and involved. There was no need, no dispute, no valid reason to do what she did to harm him and her children, outside of the mentality to retaliate against him for wanting an end and separation from years of conflicts and psychological abuse. She could have easily signed the papers with the already agreed terms of divorce but instead, was adamant on causing more conflict and the actual infliction of harm.

After having abandoned the children with Timothy for nearly a year, the estranged wife had come back without notice knowing of the protective order against her for no contact.  She took them while he was in the hospital ICU recuperating from a serious diabetic condition. She called the hospital and asked about his situation, had her best-friend babysitter take them to her, then refused to return them in violation of the protective order, disrupting again, her children’s life with him and his recuperation.

It can be seen how anxiety disorder would play a significant role when the quest is to cause harm to a type-1 diabetic. The autopsy report says Timothy died naturally from his diabetic condition and had as well, a history of anxiety disorder.

To understand why Timothy’s blood sugars were so high (>800 mg/dL), when he was using an insulin pump that was checked as operational, it was referenced by “Bing-CoPilot” that, “Anxiety can cause high blood sugar levels in some people, especially those with diabetesThis is because anxiety can trigger the release of hormones that increase cortisol and glucose levels, as part of the body’s fight-or-flight responseAnxiety can also affect insulin production or sensitivity, which can raise blood sugar levels.

Anxiety disorder significantly increases mortality risk.

The factors given as known causes that did in fact contributed to Timothy’s anxiety disorder and escalated his diabetic condition most significantly was a “traumatic life event.

It was known that Timothy’s relationship with his wife was strained, especially with the decision to divorce. However, the kidnapping of Timothy’s children’s and the events that transpired that prevented him from getting them back, was the traumatic event that contributed significantly to his anxiety disorder and escalated his diabetic vulnerability to his demise.

Valid court orders to protect Timothy and his three boys were served on the estranged wife, but she purposely continued to ignore the order, after receiving aid from the police and other legal authorities whose acts or lack thereof were and still are complicit and condoning of the violations of the order by the kidnapping of Timothy’s children, January 9, 2024, obviously before his demise, March 2, 2024.

Having reported the children as being illegally taken, they are still held hostage away from the life they had and could still have with their families. Timothy is gone, but his boys are left with a mother who abused them their entire lives by neglectful and abusive behavior. Now she can expect to continue and get paid for having them. Their happy and supportive life was with their father, but he could no longer carry the weight of callousness, depravity, and betrayal.

The emergency motion Timothy filed just days before his death, along with his and dad’s multiple Criminal Complaints filed with the court and with other legal authorities, corroborate the findings outlined in both the autopsy report and the hospital’s ICU records.

Timothy’s autopsy report supports the diagnosis drawn by the hospital’s ICU doctors notably, that Timothy experienced the same diabetic emergency on January 9, 2024, as he did on March 2, 2024.

The major difference is that on January 9, Timothy’s boy’s and the babysitter were there to help him. On Saturday, March 2, 2024, “but for” the intentional criminal acts committed by estranged wife, Sarea Laron McCree, her sister Heiress Dupree, McCree’s best friend and children’s babysitter, Brittany Houston, and their police accomplices, with the cities of El Mirage and Mesa, Arizona, Timothy’s boys would have been with him. And as they had done in the past, medical aid could have been gotten, especially given the fact that Timothy’s older brother and teen-aged nephew lived in the same apartment complex.

The application of felony-murder and slayer laws are warranted.

“Arizona’s slayer statute (A.R.S. § 14-2803), purpose is to prevent a person who kills someone from inheriting or otherwise receiving any of their victim’s benefits or property. While the statute most commonly comes into play when the killer has been criminally convicted for his actions, it can also be used to disinherit killers who avoid conviction.

In 2012, the Arizona Legislature expanded the “Slayer Statute”, ARS 14-2803, to include manslaughter. However, as the Arizona Appellate Court set-forth, kidnapping remains an ongoing crime only so long as the defendant maintains control of the victim, restraining the victim’s freedom. State v. Scott (Ariz.App. Div. 1 2017) 243 Ariz. 163, 403 P.3d 595.

The Arizona Felony Murder Rule also applies when a death occurs during the ongoing commission of a felony or felonies as in this case’s custodial kidnapping.
